Terms of Service

1. Agreement

These terms govern your use of the websites and applications operated by Shrestha Co (“Shrestha Co”, “we”, “us”). By using any of them, you agree to them. If you do not agree, please do not use them.

2. What these terms cover

These terms apply to:

  • shresthaco.com — this website, including its blog and contact forms;
  • every subdomain of shresthaco.com, including games.shresthaco.com (OmniPlay), and any product subdomain we launch in future; and
  • any mobile application we distribute, including applications on the Google Play Store that wrap one of our websites.

Collectively, these are the “Services”. Individual products may publish additional terms; where they conflict with these, the product-specific terms govern for that product.

3. Using the Services

Our games and tools are provided free of charge and generally require no account. You may use them for personal, non-commercial purposes.

You agree not to:

  • use the Services in violation of any applicable law or regulation;
  • attempt to gain unauthorised access to our systems, accounts or networks, or probe or test their security without our written permission;
  • interfere with or disrupt the Services, including by sending automated traffic, scraping at a volume that degrades service, or attempting to overload our infrastructure;
  • submit content through our contact or waitlist forms that is unlawful, abusive, deceptive, or that you have no right to send;
  • use our forms or endpoints to send unsolicited commercial messages; or
  • reverse engineer, decompile or attempt to derive source code from our applications beyond what applicable law expressly permits.

We may suspend or block access to anyone who breaks these rules, without notice.

4. Your data and your device

Our games store progress and settings on your device rather than on our servers. That has a consequence worth stating plainly: we cannot recover your saved games or settings if you clear your browser data, uninstall the application, or switch devices. There is no backup on our side, because there is no copy on our side.

How we handle the limited information we do receive is described in our Privacy Policy, which forms part of these terms.

5. Intellectual property

The Services, including their source code, design, text, graphics and logos, are owned by Shrestha Co and protected by copyright and other laws. You may not copy, modify, distribute or create derivative works from them except as these terms allow or the law permits.

The rules of traditional board games such as Ludo, Snakes and Ladders and Checkers are not owned by anyone. Our implementations of them — the code, artwork and interface — are.

You may link to any of our pages freely. You may quote reasonable extracts from our articles with attribution and a link.

6. Third-party content and advertising

This website may display advertising served by third parties, including Google. We do not control and are not responsible for the content of those advertisements or the sites they lead to. Any dealings you have with an advertiser are between you and them.

The Services may also link to third-party websites. We are not responsible for their content, terms or privacy practices.

7. Availability and changes

The Services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue any part of the Services at any time, including individual games or features.

Because our applications are designed to work offline, a change on our side may not reach your device until it is next online.

8. Disclaimer of warranties

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will meet your requirements, be uninterrupted, or be free of errors or harmful components.

9. Limitation of liability

To the fullest extent permitted by law, Shrestha Co will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of your use of or inability to use the Services.

Nothing in these terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, or for fraud.

10. Changes to these terms

We may update these terms as our products change. The “last updated” date above will always reflect the current version. Continuing to use the Services after a change means you accept the updated terms.

11. Governing law

These terms are governed by the laws of Nepal, and the courts of Kathmandu, Nepal will have jurisdiction over any dispute arising from them, without affecting any mandatory consumer protection rights you have where you live.
